This writ petition has been filed seeking a direction to the 1st and 2nd respondents to survey and demarcate the 6 cents of land in new R.S.no. 167/1D ( Old RS No. 167/1) situate at Agarathur Village, Kumbakonam Taluk, Thanjavur District and issue separate patta in petitioners name

2. Heard the learned counsel for the petitioner, the learned Additional Government Advocate leader appearing for the official respondents and the learned counsel for the private respondent.

3. The petitioner submitted an application to the official respondents for survey and fixing the boundaries of the aforesaid land. Since no action has been taken on the said representation, the petitioner is before this Court with this writ petition.

4. Learned Additional Government Pleader, appearing for the official respondents, submits that the representation of the petitioner's would be considered by the respondents 1 and 2 within a time stipulated by this Court.

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents to consider the petitioner's application dated 31.01.2024, conduct enquiry by hearing all the parties and pass appropriate orders on merits and in accordance with law, within a period of ten weeks from the date of receipt of a copy of this order. Needless to say, if any rival claims, the same shall be subject to the jurisdiction of the civil Court and the objections of the third respondent shall form part of the enquiry.
