O R D E R

The Writ Petition is filed seeking a direction to the second respondent to consider the Petitioner's representation, dated 21.03.2023 and cancel the patta No.1095 issued in favour of private respondents.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, the subject property originally belonged to the Petitioner's mother Jothi Fathimal's father and the Petitioner's mother was allotted 1 acre and 80 cents in a partition. Thereafter, the private respondents based on some registered documents, got patta in their name excluding the Petitioner's mother. Therefore, the instant representation has been filed seeking cancellation of patta issued in favour of private respondents and issuance of separate patta in the name of 2/5

Petitioner. The said representation has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.The Petitioner herein claims 1 acre and 80 cents of land was allotted to her mother Jothi Fathimal under an unregistered partition that had taken place in the family. The unregistered documents will not convey any good title to the Petitioner. Therefore, if the Petitioner feels that he has got any share in the subject property, it is for him to work out his remedy by filing appropriate civil suit. Since the Petitioner has no document in support of his claim that 1 acre and 80 cents was allotted in favour of his mother, this Court is not inclined to issue any direction to the official respondents.

5.Accordingly, the Writ Petition stands disposed of, with liberty to the Petitioner to move the competent Civil Court, for appropriate relief, in the manner known to law, if so advised. No costs.
