(R3 is impleaded vide Court order dated 09.08.2023 in W.M.P.(MD)No. 14509 of 2023 in W.P.(MD)No.13345 of 2023) PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the E-Auction sale notice dated 10.05.2023 and quash the same as devoid of merits consequently direct the respondents to release the possession of the house of property in Sivagangai Registration District in Madagupatti Sub District in Tiruppattur Taluk, in 71 Jayankondanillai @ Sethalai Village, in old Natham S.No.33/1, part in New Natham S.No.234/23, extent 1185 sq. ft in New Natham S.No.234/22, Extent 441 sq. ft which is standing in the name of Mr.M.Malairaj.

ORDER

(Order of the Court was made by Dr.ANITA SUMANTH, J.) On the last occasion, the respondents were directed to explore the possibility of amicable settlement, under an One Time Settlement 2/4

Scheme, if any was on-going, and also to take instructions on whether the penal interest could be waived under any existing scheme.

2. Mr.N.Dilip Kumar, learned counsel, who appears on behalf of R1 and R2 confirms that there is no possibility for either settlement or waiver insofar as the amounts quantified as being payable are admittedly outstanding and due. In fact, the petitioner has not even approached the Debt Recovery Tribunal in relation to the recovery measures taken.

3. In fact, we note that nothing survives in the matter insofar as the challenge is to the e-auction notice dated 10.05.2023. Hence, and in light of the aforesaid, this writ petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petitions are closed.
