PRAYER: Contempt Petition filed under Section 11 of Contempt of Courts Act, 1971 to initiate contempt proceedings against the Contemnors / Respondents and punish them for the willful disobedience of the order made in W.P.(MD)No.31032 of 2023, dated 21.12.2023.

O R D E R

[Order of the Court was made by R.SUBRAMANIAN, J.] The Commissioner, Pudukkottai Municipal Corporation is present.

2. Mr.R.Bhaskaran, learned Additional Advocate General would submit that the notices were served on 19 encroachers, there was stiff resistance to the removal process and after considerable negotiation and persuasion, the encroachers have finally agreed to move to the alternative accommodation identified by the Corporation. Construction of residential plots by the Tamil Nadu Urban Habitat Development Board is underway in the alternative location and it is likely to be completed by 31.03.2025. The learned Additional Advocate General would add that upon completion of the constructions, the encroachers will be moved to the newly constructed plots and the area in question will be free of encroachment. He also assures the Court that the action will be taken against the remaining encroachers.

3. Recording the said submission, this contempt petition is closed. Leaving it open to the petitioner to seek reopening, if the undertaking is not complied with. The presence of the respondents is dispensed with.
