ORDER

This Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the impugned refusal check slip No.RFL/Palukal/18/2024 dated 20.05.2024 and consequently direct the respondent to register the sale deed presented by the petitioner on 20.05.2024 within a stipulated time

2. Through the impugned order, the respondent refused to register the sale deed since the petitioner has newly laid out the property and the property is unapproved and further new road has been laid.

3. On perusing the sale deed, it is seen that already there are roads and four boundaries were marked. Further Survey No.535/6A was sub-divided as early as 1992 itself. Thereafter, it has been sub-divided and the petitioner's Survey No.535/6A1B. Therefore it is clear that it is not a newly laid out property and new road was not formed by the petitioner. Hence, the impugned order is hereby quashed. Consequently, the respondent is directed to register the sale deed presented by the petitioner on 20.05.2024 within a period of four weeks from the date of receipt of a copy of this order.
