Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to give appropriate direction to the above mentioned respondents to provide adequate police protection in life and limb based on complaint, dated 19.06.2024. O R D E R
The petitioner, a history sheet rowdy involved in thirteen cases to his credit has approached this Court, seeking police protection in a civil dispute.
2.Today(28.06.2024), when this Criminal Original Petition is taken up for hearing, the Government Advocate(Crl.side) appearing for the respondents submits that there are two civil suits pending between the petitioner and one Ramalingam and others with regard to the subject property in O.S.Nos.638 of 2021 and 484 of 2021 before the District Munsif Court and the IV Additional District Court, Madurai respectively. He has also produced the details of the criminal cases, which are pending as against this petitioner. Therefore, police protection could not be granted in the civil matters.
3. It is to be noted that the petitioner has not added the respective parties as respondents, against whom the petitioner is having threat. Moreover, the petitioner is a history sheeted rowdy, for which, the learned Government Advocate (Crl.side) has produced the case details, 2/4
which are pending as against this petitioner. Since civil suits are pending between the parties, the petitioner can work out his remedy before the appropriate civil Forum.
4.In view of the above, this Criminal Original Petition is dismissed.
