Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent Nos.1 and 2 to grant ordinary leave for a period of 30 days to the petitioner's son namely Mareeswaran (CP NO.1353) who is languishing in the Madurai Central Prison by considering the petitioner's representation dated 06.05.2025.

ORDER

(Order of the Court was made by S.SRIMATHY,J.) The writ petitioner is the mother of the life convict and for attending serious illness of his father, she has sought for thirty(30) days emergency leave to the convict through her representation dated 06.05.2025. 2.The learned Additional Public Prosecutor appearing for the respondents, on instructions, states that the representation of the petitioner has been considered in accordance with law and thirteen(13) days emergency leave without escort may be granted to the life convict to attend the serious illness of his father. The learned Additional Public Prosecutor further states that the detenue may inform the prison authority about the convenient period for which he wants thirteen days emergency leave for the purpose of attending serious illness of his father.

3.Considering the submission made by the learned Additional Public Prosecutor and the purpose for which the leave sought, this Court is of the opinion

that the son of the petitioner shall be granted emergency leave for thirteen days without escort to attend serious illness of his mother. 4.With the above observation and direction, this Writ Petition stands disposed of. No costs.
