PRAYER : Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the second respondent not to harass the petitioner under the guise of enquiry in the civil dispute.

O R D E R

This petition has been filed by the petitioner seeking a direction to the second respondent not to harass the petitioner under the guise of enquiry on the basis of the complaint given by the third respondent herein.

2. When the matter is taken up for hearing, the learned counsel for the petitioner would submit that there is property dispute between the petitioner and third respondent and the third respondent has given a complaint based on which the second respondent is making enquiry and harassing the petitioner.

3. The learned Additional Public Prosecutor would submit that based upon the complaint given by third respondent herein enquiry was undertaken in CSR Nos.141/2021 A perusal of the statement given by the third respondent would show that during the course of enquiry the petitioner has given an undertaking that he will not make any trouble to the third respondent on that ground he did not press the complaint. So, it was closed on 18.06.2021.

Crl.O.P.(MD)No.11798 of 2021 4.Since the complaint given by the third respondent has been closed on the basis of the undertaking given by the petitioner, no consideration or direction is required in this petition.
