Side) C O M M O N O R D E R Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for respondents 1 to 3.

2. The petitioners' counsel states that the civil suit is pending between the parties. The fourth respondent is trying to short circuit the process by lodging the complaint. The petitioners' counsel states that the incumbent Deputy 1/3

Superintendant of Police appears to be acting at the instance of the fourth respondent.

3. The learned Additional Public Prosecutor states that the complaint given by the fourth respondent is being enquired into by the second respondent.

4. The jurisdictional police station appears to be the third respondent. Therefore, the petition mentioned enquiry shall be concluded within a period of four weeks from the date of receipt of a copy of this order. The third respondent will issue summons in writing, if he wants to enquire the petitioners. There cannot be any oral summon for attending enquiry. If the third respondent registers any FIR, the petitioners will be given due notice, so that, the petitioners will have breathing time to move the concerned Court for the relief of anticipatory bail. 5.With this direction, these criminal original petitions are disposed of.
