ORDER
This writ petition has been filed for a Writ of Mandamus directing the respondent to remove the high tension wire running above the house of the 1/4
petitioner at S.No.343/1B at Thisayanvilai Village, Radhapuram Taluk, Tirunelveli District.
2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.
3. The case of the petitioner is that she has made an application for shifting of the high tension wire which is running above her house and she has paid the necessary charges for shifting the high tension wire on 21.03.2025. However, the respondent has not shifted the high tension wire on the ground that the neighbours of the petitioner are raising objection. Shifting of the high tension wire at the behest of the neighbours itself can not be a reason. If the shifting of high tension wire is going a cause or any other distress to the neighbours, such shifting can be refused. In this case, a feasibility report would have been generated before the request for shifting of the high tension wire was considered and ordered on 21.03.2025.
2/4
4. Therefore, this Court directs the respondent to shift the high tension wire within a period of 30 days from the date of receipt of a copy of this order. In the event of the respondent requiring any police protection, the respondent may seek assistance of the local police at the time of shifting the high tension wire. It is needless to say that before shifting of the high tension wire shall not be at the perill of any of the neighbours.
5. Accordingly, the writ petition is disposed of. No costs. 09.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No am 3/4
