PRAYER: Writ Petition filed under Article 226 of the Constitution of India, issue a of a Writ of Mandamus, to direct the respondents herein to regularize the services of the petitioners as Assistant Engineers and Junior Assistant respectively in the 2nd respondent office, as per the proposal sent by the 2nd respondent to the 1st respondent in Lr.No.4167/ADMN/2017 dated 12.08.2020, with regular pay and all other service benefits on par with regular employees.

This Writ Petition has been filed for a Mandamus seeking to regularise the services of the petitioners as Assistant Engineers and Junior Assistants respectively in the second respondent office. 2.In identical set of facts seeking the very same prayer by similarly placed persons who are working in the second respondent 3/8
office as Assistant Engineers and Junior Assistants respectively, the Principal Seat of this Court by the order of the learned Single Judge dated 24.02.2025 passed in W.P.Nos.17971 & 19550 of 2023, dismissed the said Writ Petitions, by giving the following reasons: "9.When the Government vide its letter dated 11.07.2022 rejected the claim to regularise the petitioners and further vide letter dated 27.07.2022, upon request of the petitioner, the Chairman TANGEDCO agreed to utilize the services of the 53 persons, that too on contractual employment, provided their services were continued on the rolls of TEDA, also, it is the petitioners, who have not taken up the contractual engagement that had been extended to them, therefore, the prayer of the petitioners seeking to regularize them cannot be granted.
Also with regard to the payment of salary, if any, to be payable to the petitioners, the same shall be paid by the respondents in accordance with law." 3.Since the petitioners in this Writ Petition are similarly placed, the petitioners are also not entitled to seek regularisation. Hence, this Writ Petition also will have to be dismissed.
if found that the petitioners are entitled for the same, within a period of four [4] months from the date of receipt of a copy of the order. 4.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
