The petitioner with an allegation that the respondent police is harassing the petitioner under the guise of an enquiry has approached this Court.

2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondents 1 & 2 and submits that the third respondent has lodged a complaint before the Inspector General of Police, which was forwarded for an enquiry before the respondent police and the respondent police has conducted the petition enquiry. Since the dispute is with regard to the temple administration and the maintenance of the accounts of the temple, the matter was referred to the Revenue Divisional Officer, Sattur on 01.07.2024.

3.The learned counsel appearing for the petitioner submits that the third respondent is in the administration of the temple and has misappropriated the temple fund. Further, he has not taken any steps to audit the temple accounts from the year 2014. The learned counsel further submits that instead of taking action as against the third respondent for the misappropriation of temple funds, the respondent police is helping him by referring the matter to the Revenue Divisional Officer.

4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The third respondent has lodged a complaint as against the petitioner, based on which, the respondent police has conducted a petition enquiry. However, the respondent police has referred the matter to the Revenue Divisional Officer. Since the respondent police has taken a stand that the complaint has been forwarded to the Revenue Divisional Officer as it is an issue relating to the administration of the temple, the petitioner shall establish his case /work out his remedy before the Revenue Divisional Officer.
