Govindan ... Respondent PRAYER: Petition filed under Article 227 of the Constitution of India, seeking a direction the learned Subordinate Judge, Srivilliputhur, to expedite the trial and dispose of the case in O.S.No.371 of 2015, within a stipulated time limit. For Petitioners : Mr.P.Santhanakrishnan *****
ORDER
This Civil Revision Petition has been filed seeking a direction to the learned Subordinate Judge, Srivilliputhur, to dispose of the suit in O.S.No.371 of 2015, within a stipulated time limit.
2. Learned Counsel for the petitioners would submit that the petitioners herein are senior citizens and the respondent herein is their son. The respondent, as plaintiff, has filed the suit in O.S.No.371 of 2015, for the relief of partition of 1/2 share of the suit schedule property, against his own parents, viz., the petitioners herein. According to the petitioners, they are having exclusive right over the suit schedule property and they had filed their written statements as early as June, 2016. But, the respondent, instead of contesting the case, is taking mechanical adjournments and therefore, the petitioners are before this Court seeking a direction for the Court below for early disposal of the suit proceedings.
3. Heard the learned Counsel for the petitioners and perused the materials available on record. Notice to the respondent is dispensed with, since the prayer itself is for a limited scope seeking early disposal of the suit proceedings.
4. Considering the facts and circumstances of the case and also taking note of the age of the suit, this Court, without going into the merits of the case, directs the learned Subordinate Judge, Srivilliputhur, to dispose of the suit in O.S.No.371 of 2015, within a period of six months from the date of receipt of a copy of this order.
