Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents to pay the retirement benefits and consequently direct the respondents 1 and 2 to pay pension from 31.7.2007 with 10% interest for arrears and continue to pay pension every month and direct the 2nd respondent to pay surrender leave salary, gratuity, provident fund, engineering college contribution Welfare Scheme (E.R.B.S) with 10% interest from date of retirement 31.7.2007 and also to provide free bus pass cum retirement I.D Card to the petitioner.

O R D E R

Seeking retirement benefits and also to pay pension, the petitioner has come before this Court.

2.Heard the learned counsel appearing for the petitioner and the learned Standing Counsel for the respondents. 3.The grievance of the petitioner is that though he retired from service on 31.07.2003, the retirement benefits, such as surrender leave salary, gratuity, provident fund, Engineering College Contribution Welfare Scheme (E.R.B.S) etc., have not been disbursed. Hence, he sent a letter to the second respondent dated 15.12.2016 seeking such benefits. Since the same has not been considered, the petitioner is before this Court. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Standing Counsel appearing for the respondents submitted that the letter has been sent in the year 2016 and therefore, the petitioner may be directed to send a fresh representation to the respondents and on such filing, the same will be considered on merits.

5.In such view of the matter, the petitioner is directed to submit a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order and on such filing, the respondents are directed to consider the same and pass appropriate orders on merits and in accordance with law, within a period of six weeks thereafter, after affording an opportunity of hearing to the petitioner.

6.The writ petition is disposed of with the above direction. No costs.
