PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the first respondent to depute a special investigation officer to investigate the case in Crime no.43 of 2021, on the file of the second respondent police. For Petitioner : Mr.D.Rajaboopathy For R1 & R2 : Mr.R.M.Anbunithi Additional Public Prosecutor.

ORDER

This petition has been filed seeking a direction to the first respondent to depute a special investigation officer to investigate the case in Crime no.43 of 2021, on the file of the second respondent police.

2.The case of the petitioner is that her husband died in a road accident which occurred on 10.02.2021. A case was registered on 11.02.2021 in Crime No.43 of 2021 for the offences punishable under Sections 279 and 337 IPC. The grievance of the petitioner is that even after identification of the accused person, no investigation has been taken on this aspect. Hence, this petition.

3.The learned Additional Public Prosecutor would submit that based on the complaint given by the petitioner, case has been registered and 7 witnesses have been examined so far.
