Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C. to direct the second respondent to provide police protection to the petitioner's punjai land in Survey No.145/10 to an extent of 57 cents in Nelkattumseval Village, Sivagiri Taluk, Tirunelveli District for surveying and measuring by surveyor and take action on the petitioner's complaint dated 13.09.2017. For Petitioner : Mr.T.Muthuvelan For Respondents : Mr.A.Robinson No.1 and 2 Government Advocate (Crl.side)

ORDER

This Criminal Original Petition has been filed for a direction to direct the second respondent to provide police protection to the petitioner's punjai land in Survey No.145/10 to an extent of 57 cents in Nelkattumseval Village, Sivagiri Taluk, Tirunelveli District for surveying and measuring by surveyor and take action on the petitioner's complaint dated 13.09.2017. 2.The learned counsel for the petitioner would submit that the petitioner owned a land in Survey No.145/10 to an extent of 57 cents in Nelkattumseval Village, Sivagiri Taluk, Tirunelveli District. He would also submit that the respondents 3 and 4 are adjacent owners and unnecessarily interfering and harassing the petitioner for which the petitioner has given a complaint to the second respondent on 13.09.2017. He would further submit that the petitioner is aged about 80 years an octogenarian and that he has no male children and the respondents 3 and 4 are unnecessarily harassing him.

3. The learned Government Advocate(Crl.Side) would submit that

based on the complaint given by the petitioner all the parties were summoned for enquiry and during enquiry the third and fourth respondent had agreed to survey their land and both of them have also given a written undertaking that both of them agreed to proceed against each other before the appropriate forum to survey the land.

4. Hence there shall be a direction to the second respondent to give suitable police protection to the petitioner while surveying and measuring his land in Survey No.145/10 in Nelkattumseval Village, Sivagiri Taluk, Tirunelveli District .

5. The Criminal Original Petition is closed with the above direction.
