This Writ Petition has been filed challenging the impugned selection of the fourth respondent to the post of Sanitary Supervisor in Ammaiyanayakanur Town Panchayat vide proceedings dated 29.07.2021.

2.The petitioner challenges the appointment of the fourth respondent through the aforementioned proceedings. The petitioner also participated in the very same selection process. According to the petitioner, the fourth respondent is not eligible to hold the post of Sanitary Supervisor. According to him, the fourth respondent has not been sponsored through the employment exchange and since the fourth respondent's father A.Nagarajan, was the District Deputy Secretary of DMK, Dindigul, by using his influence, the fourth respondent got an appointment order appointing him as Sanitary Supervisor in Ammaiyanayakanur Town Panchayat. 3.A counter has been filed by the second respondent on behalf of the respondents 1 to 3 [official respondents], denying the contentions of the petitioner.

They have stated that only by following the due procedure established under law, the fourth respondent is appointed to the post of Sanitary Supervisor. They have stated that the Town Panchayat invited eligible candidates from the District employment office and issued public notice, to fill up the post of Sanitary Supervisor and six candidates have applied and one among them is the petitioner.

28.07.2021. Eventhough the petitioner and the fourth respondent were found eligible to attend the interview, the selection of the fourth respondent was based on suitability and approval of the competent appointment committee.

4.As seen from the affidavit filed in support of this Writ Petition, only bald allegations has been levelled by the petitioner against the fourth respondent, who has been appointed to the post of Sanitary Supervisor under the impugned proceedings. The said bald allegations are not supported by any documentary evidence. The respondents 1 to 3 as well as fourth respondent who has been appointed as Sanitary Supervisor have denied the allegations of the petitioner.

The respondents 1 to 3 [official respondents] have categorically stated that only by following the due procedure by inviting eligible candidates from the district employment office and issuing public notification, to fill up the post of Sanitary Supervisor and by holding an interview in which the petitioner also participated, the fourth respondent was duly appointed to the post of Sanitary Supervisor as the fourth respondent was found suitable for being appointed to the post of Sanitary Supervisor by the competent appointment committee.

respondent has been appointed under the impugned proceedings as early as on 29.07.2021. The fourth respondent has also taken charge of the said post ever since the date of the impugned proceedings and is continuing to work as Sanitary Supervisor in Ammaiyanayakanur Town Panchayat ever since 2021. When there is no material placed on record by the petitioner to prove that the fourth respondent was appointed arbitrarily and illegally as Sanitary Supervisor under the impugned proceedings dated 29.07.2021, the question of entertaining this Writ Petition does not arise. 5.Since there is no merit in this Writ Petition, this Writ Petition stands dismissed.
