Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd and 3rd respondent to cancel the permission granted to the 6th respondent, for quarrying the granite in the entire land, comprised in S. No.296/2 and S. No.296/3 in Vijaya Naryanam Village II, Nanguneri Taluk, Tirunelveli District, by disposing the petitioners representation dated 18.08.2023 and as forwarded by the 1st respondent.

ORDER

This writ petition has been filed to direct the respondents to consider petitioner's representation dated 18.08.2023. 2/6

The learned counsel for the petitioner would submit that in this case, the petitioner has filed a representation dated 18.08.2023 requesting the 2nd respondent to cancel the permission granted to the 6th respondent, for quarrying the granite in the subject land. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned counsel appearing for the official respondents would submit that the petitioner's representation dated 18.08.2023 will be disposed of by the respondent within a period of 4 weeks.

4. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the 2nd respondent to provide sufficient opportunities to all the parties and thereafter pass appropriate 3/6

orders, based on the petitioner's representation dated 18.08.2023, on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order.
