by the 1st Respondent in Ku.No.234/388/ThaPo/Pa/MaThu/Mu-NIA/NI-PI-A4/A4.3/2024 dated 06.06.2024 and quash the same as illegal and consequently direct the respondents to allow the petitioner to retire on superannuation on 30.06.2024 with all attendant monetary retirement benefits to be paid within a stipulated period fixed by this Court. ORDER
The writ petition has been filed challenging the impugned show cause notice issued by the 1st Respondent dated 06.06.2024 and to direct the respondents to allow the petitioner to retire on superannuation on 30.06.2024 with all attendant monetary retirement benefits to be paid
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3. By consent, the writ petition itself is taken up for final disposal.
4. The petitioner is working in the respondent department and is going to retire on 30.06.2024. While so, she was kept under suspension. She was also issued with a charge memo and initiated disciplinary 2/5
proceedings against her. Hence, she filed a writ petition before this Court challenging the said proceedings in WP(MD) No.12133/2024, which was disposed on 10.06.2024 by giving a direction to the respondents to conclude the enquiry within a period of two weeks. Now, the petitioner has been given with the show cause notice on 06.06.2024, for which, the petitioner has also given an explanation.
5. Since the petitioner has already given her explanation to the impugned show cause notice, the respondents are directed to consider the same and pass orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
6. The writ petition is disposed of with the above direction. No costs. Consequently connected Miscellaneous Petitions are closed. 26.06.2024 RR 3/5
