ORDER

This writ petition has been filed seeking for a direction to the 1st respondent to change of investigation on the petitioner's complaint dated 13.04.2026 from the file of 3rd respondent to 2nd respondent.

The learned counsel appearing for the petitioner submitted that the petitioner was defrauded by the 4th respondent to the tune of Rs.99,30,000/- on the false promise of securing employment for him in Jordan. It was further submitted that, despite receiving the said amount, the 4th respondent neither secured the promised employment nor returned the money and thereby cheated and defrauded the petitioner. The petitioner also alleges that he was subjected to harassment at the hands of the 4th respondent. In this regard, the petitioner had already lodged a complaint before the 3rd respondent police. However, according to the petitioner, the complaint has not been properly investigated. Therefore, the petitioner has approached this Court seeking a direction to the 1st respondent police to transfer the investigation of the petitioner's complaint 2/6

from the file of the 3rd respondent and entrust the same to some other competent investigating agency for a fair and effective investigation.

3. The learned Government Advocate appearing for the respondent police submitted that the 4th respondent is a company having its operational office at Delhi. It was further submitted that the petitioner's complaint has been received by the respondent police and that the enquiry is presently pending.

4. Heard the learned counsel on either sides and carefully perused the materials available on record. Since no adverse order is proposed to be passed against the fourth respondent, notice to the fourth respondent is dispensed with.

5. However, considering the nature of the allegations and the complexity involved in the present complaint, as highlighted by the learned counsel for the petitioner, this Court is of the view that the matter warrants expeditious action on the part of the respondent police.

6. Accordingly, the first respondent police is directed to take necessary steps to secure the presence of the 4th respondent by issuing notice under Section 64 of the BNSS and ensure his appearance before the 3rd respondent 3/6

police. Upon such appearance, the 3rd respondent police shall conduct a proper enquiry into the petitioner's complaint and conclude the same as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. The first respondent is directed to monitor the ongoing enquiry conducted by the 3rd respondent and the third respondent is directed to appraise the same to the first respondent every Friday.
