The Petitioner herein seeks a direction to the second respondent to conduct an enquiry based on the Petitioner's representation, dated 15.05.2023 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.The Petitioner herein claims that 24.20 cents of land in Plot No.84 in S.No.81/17 was purchased by the Petitioner's grand father Muthaiah Chettiar. Now the Petitioner and his brother Narayanan has been enjoying the same by virtue of succession. It is further stated by the Petitioner that the property purchased by the Petitioner's grand-father was wrongly assigned in favour of one Muthu Rowther without notice to him. Therefore, the petitioner submitted the instant representation seeking cancellation of patta No.261 issued in the name of Muthu Rowther and for issuance of patta in the name of Petitioner and his brother Narayanan. The said representation has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 2/5
4.A reading of the representation submitted by the petitioner would indicate that based on patta issued in favour of Muthu Rowther, number of registered documents came into existence and various pattas were issued in favour of the alienees and sub division has been effected based on those registered documents. Therefore, it is clear that after issuance of patta in favour of Muthu Rowther, various registered transactions had taken place and sub-division has been effected based on those registered documents. In such circumstance, the validity of the same cannot be gone into by the revenue officials and it is for the Petitioner to work out his remedy by filing civil suit. Hence this Court is not inclined to issue any direction to the official respondents. 5.
Accordingly, the Writ Petition stands disposed of, with liberty to the Petitioner to work out his remedy before the Civil Court. In view of the order passed in the main Writ Petition, the impleading application is closed. No costs. The petitioner is entitled to exclude the time taken by him in prosecuting the present writ Petition before this Court from 6.6.2023 to the date of receipt of a copy of this order,while calculating limitation for civil proceedings to be initiated by him.
