ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC r/w 21(1) of Mines and 1/3

Minerals (Development and Regulations) Act, 1957, in Crime No.299 of 2024 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused have illegally transported 1⁄4 unit of river sand in a bullock cart. 3.The learned counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. 4.The learned Government Advocate (Crl. side) has raised serious objections that the petitioner is having six previous cases, out of which, four cases are similar in nature.

5.Considering the antecedents as against the petitioner, this Court while granting bail to the petitioner in the previous case, which was registered in Crime No.189 of 2024, directed the petitioner to file an undertaking affidavit before the concerned Judicial Magistrate at the time of furnishing sureties that he will not indulge in any further offence in future. That order was passed on 24.04.2024. After coming out on bail, the petitioner has involved in similar offence within one month. 6.Considering the conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
