PRAYER :- For Bail in Crime No.94 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner is facing charges under Sections 147, 148, 149, 294(b), 109, 302, 307, 120(b) and 506(ii) r/w Section 114 IPC in Crime No.94 of 2021 on the file of the respondent police. 2.The defacto complainant moved W.P.(MD) No.8621 of 2021 before this Court seeking a direction to the trial Court to complete the trial process within the stipulated time. This Court by order dated 26.11.2021 directed the concerned Court to complete the trial on day-to-day basis. Even after a lapse of several months, it appears that the order was not complied by the concerned Court. This petitioner along with co-accused moved Crl.O.P.(MD) No.9169 of 2022 seeking bail. By order dated 18.05.2022, that petition was also dismissed taking note of the bad antecedents of the petitioner. https://www.mhc.tn.gov.in/judis
3.So, this petitioner moved this petition on the ground that he is not involved in any previous case and he is in judicial custody for more than a year. But there is already an order passed by this Court, directing the concerned Court to conduct trial on day-to-day basis. The reason for non-compliance is not known. In such cases, the petitioner can approach the concerned Court for bail. Meantime, Registry is directed to call for a report from the concerned Court as to why the order dated 26.11.2021 was not complied with. 4.With the aforesaid liberty, this Criminal Original Petition is disposed of.
