ORDER : The Court Made the following order :- The petitioners are in judicial custody since 06.09.2018 for the alleged offences under Sections 294(b), 353, 307 and 379 I.P.C (Sand Theft) in Crime No.281 of 2018, on the file of the respondent Police. The petitioners are arrayed as Accused Nos.1 and 5. They seek bail.

2.The case of the prosecution is that when the de-facto complainant was conducting usual checkup, at that time, he came to know that the accused person was illegally trying to transport the river sand by using tractor. Hence, the respondent police registered a case.

4.The learned Additional Public Prosecutor appearing for the respondent police submits that the quantity of sand involved is two units and the same was recovered by the respondent police. He further submitted that there are seven accused in this case. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the above facts and circumstances and also considering the period of incarceration undergone by the petitioners

from 06.09.2018, this Court is inclined to grant bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail subject to the following conditions: (i) the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Tenkasi.

(ii)the petitioners shall report before the respondent Police daily at 10.30 a.m. until further orders.
