Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance a writ of Mandamus, directing the respondent to provide draft final voter list to the constituency of Madurai North (191), Madurai South (192), Madurai Central (193), and Madurai West (194) to the petitioner by considering the representation of the petitioner's dated 04.10.2017 within a stipulated time as may be fixed by this Court. ORDER

This writ petition is filed seeking a writ of Mandamus, to direct the respondents to provide draft final voters list of the constituencies viz., Madurai North (191), Madurai South (192), Madurai Central (193), and Madurai West (194) to the petitioner by considering the representation dated 04.10.2017 within a stipulated time.

2.The learned counsel appearing for the petitioner would submit that the petitioner is the District Secretary of a political party and the name has been assigned by the Election Commission to their faction. Since the Election Commission has proposed to conduct a Special Camp on 18.10.2017 all over the State, the petitioner requested the second respondent to furnish the list of voters, who in turn rejected such request stating that their faction is not registered under the Election Commission, where as the list of voters has been provided to their rival faction. Hence, the petitioner sent a representation to the first respondent on 04.10.2017, to provide the draft final voters list https://hcservices.ecourts.gov.in/hcservices/

and same has not been considered yet by the respondents, the petitioner is before this Court, seeking a direction to the respondents to provide the voters list to the petitioner. 3.The learned Standing Counsel for the respondents, on due instructions would submit that if the petitioner applies for a copy of voters list on paying necessary cost, the same would be furnished to the petitioner.

4. In view of the above submissions, the petitioner is directed to submit the application and pay necessary cost before the respondents and upon payment the respondents are directed to furnish the list of voters as same as issued to the other parties, forthwith.

5.With the above directions, the writ petition is disposed of. No Cost.
