PRAYER: Contempt Petition is filed under Sections 11 of the Contempt of Courts Act, to punish the respondent for her deliberate and willful disobedience of the order of this Court made in Crl.O.P(MD). No.649 of 2019, dated 25.10.2019 and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondents 1 and 2 to secure the 3rd respondent as per warrant issued by the learned Judicial Magistrate Court, Sankarankovil in CC NO. 27/13. O R D E R

This contempt petition has been filed to punish the Contemnor/Respondent herein for the willful disobedience of the order passed by this Court in Crl.O.P(MD).No.649 of 2019, dated 25.10.2019.

2.This Court, by an order, dated 25.10.2019 in Crl.O.P(MD). No.649 of 2019 directed the second respondent police to execute the non-bailable warrant issued as against the third respondent in C.C.No.27 of 2013 on the file of the Judicial Magistrate Court, Sankarankovil, within a period of four weeks from the date of receipt of a copy of that order.

Cont.P.(MD).No.916 of 2020 3.Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.side) appearing for the respondent police would submit that as directed by this Court, now the respondent police has found that the accused is residing in Kerala. Therefore, he seeks further four weeks time to secure the accused and to execute the non-bailable warrant issued as against the third respondent as directed by this Court. It is also seen that the petitioner is directed to assist the second respondent to execute the Non Bailable Warrant.

4.Considering the above submission made by the learned Government Advocate (Crl.side), the respondent police is directed to secure the accused in C.C.No.27 of 2013 on the file of the Judicial Magistrate Court, Sankarankovil within a period of four weeks from the date of receipt of a copy of this order. Further it is also made clear that the petitioner is directed to assist the respondent while executing Non Bailable Warrant.

5.With the above directions, this Contempt Petition is disposed of.
