PRAYER :- For Bail in Crime No.3 of 2018 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 27.06.2022 for the alleged offence punishable under Sections 406, 506(i), 294(b) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.3 of 2018, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that there was a dispute between the husband and wife. The present case has been taken cognizance in C.C.No.383 of 2019 on the file of the Additional Mahila Court (Magisterial Level), Madurai. Due to the absence of the petitioner warrant was issued against him when he was in abroad. Later, when he came to India, he was arrested by the respondent police and remanded to judicial custody.

3. Today, when the matter was taken up for hearing at 11.30 a.m., the learned counsel for the both parties submitted that there is a possibility of settlement between the parties and hence, the matter was adjourned to 11.07.2022. Later at 3.00 p.m., the petitioner counsel appeared before this Court and stated that the parties have settled the matter amicably and he has also placed the agreement entered into between them before this Court.

4. Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

5.Considering the facts and circumstances and also considering the fact that the parties have settled the matter amicably by way of entering compromise, this Court is inclined to grant bail to the petitioner on condition that the petitioner shall return the disputed jewels on 11.07.2022, when the matter is going to be heard before the Family Court, Madurai.

6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a own bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional Mahila Court (Magisterial Level), Madurai, and on further condition that the petitioner shall report before the respondent police as and when required for interrogation. sd/- 07/07/2022 / TRUE COPY / 08/07/2022 Sub-Assistant Registrar (C.S.)
