JUDGMENT
This Criminal Appeal has been filed by the appellants / accused Nos.1 and 4, challenging the order dated 16.05.2025 passed by the Vacation Sessions Court, Karur, in Vacation Crl.M.P.No.19 of 2025 and release the appellant on bail in S.C.No.17 of 2021 on the file of the Principal District and Sessions Judge, Karur.
2. The accused have been charged for the offences under Sections 302, 120(B), 506(ii), 294(b), 109, 114 of IPC read with Section 3(2)(v) of SC/ST (POA) Act. After the investigation was completed, charge sheet has been filed and the same was taken on file in S.C.No.17 of 2021. Now the case is 2 / 6
pending for trial. Eventhough the accused have been enlarged on bail, they did not comply the conditions imposed by the Court while granting bail and that had resulted in securing them once again on warrant. Thereafter, they were remanded to judicial custody. Now, they are confined at the Central Prison, Trichy. The petition filed by the petitioners before the trial Court, to enlarge them once again on bail was dismissed. Aggrieved over that the petitioners have preferred this appeal.
3. Learned counsel for the petitioner submitted that the petitioners will be prompt in making their appearance before the Court for the rest of the hearings. The reason for the non appearance of the first appellant before the trial Court, is due to his marriage arrangements and that of the second appellant was due to his illness. The petitioners are first and fourth accused out of the twelve accused involved in the case.
4. It appears from the order of the trial Judge that the trial of the case has been almost completed and the case is on the defence stage. The above order has been passed on 16.05.2025. At this concluding stage, it would be appropriate for the petitioners to depose any evidence on their side, if they 3 / 6
prefer to do so or to advance their arguments in order to get the case over. Releasing the accused at this stage would risk the completion of the trial.
5. As the trial is going to be completed shortly, I do not find any reason to enlarge the accused once again on bail, in the present stage.
