ORDER
The present writ petition has been filed seeking a mandamus as against the respondents 2 and 3 to effect electricity service connection to the petitioners' four godowns situated in D.No.33 Kamak Road, Sivakasi, Virudhunagar District.
2. According to the writ petitioners, totally there are 11 godowns, out of which, seven are in possession of the 4th respondent, who is none other their brothers. The balance four godowns are in their possession. However, the possession of the petitioners with regard to four godowns is disputed by the 4th respondent.

3.The learned counsel for the 4th respondent submits that the petitioners herein as plaintiffs have filed OS No.132/2024 on the file of the Principal District Court at Srivilliputhur seeking partition in which they were not averred anything about the possession of the four godowns. He further submitted that he is possession of four godowns at D.No.33 Kamak Road, Sivakasi, Virudhunagar District and therefore, service connection should not be given to the writ petitioners. 4.Considering the fact that there is a partition suit between the parties, without affecting the rights of the parties in the partition suit, the respondents 2 and 3 are directed to effect electricity service connection to the four godowns in D.No.33 Kamak Road, Sivakasi, Virudhunagar Distribution in the name of the 4th respondent on payment of necessary charges. This Court makes it clear that merely because electricity service connection is given in the name of the 4th respondent, that cannot be taken advantage by them in the civil suit.
