The petitioner / accused, who was arrested and remanded to judicial custody on 08.11.2024, for the alleged offence punishable under Section 307 IPC @ 302 IPC in S.C.No.66 of 2024 on the file of the Additional District and Sessions Judge, Dindigul in Crime No.2 of 2024 on the file of the respondent-police seeks bail.

2. The case of the prosecution is that due to money dispute, the petitioner herein is said to have poured the petrol and set fire on the deceased, who is the son of the defacto complainant. Hence, the case.

3. The learned counsel appearing for the petitioner submits that due to nonappearance of the petitioner before the trial Court NBW was issued and that he was arrested and remanded to judicial custody on 8.11.2024. He further submits that the petitioner is a daily wage person and he went to Thirupur for work and that he could not appear before the trial Court. He further submits that the petitioner has been in judicial custody since 8.11.2024 and hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl. side) appearing for the respondent-Police, submits that there are two previous cases pending against the petitioner, out of which, one case is relating to murder. He further submits that if the petitioner is released on bail he may abscond and thereby, cause delay in trial proceedings. Hence, he prays for dismissal of this petition. 2/4

5. Heard on both sides and perused the records. This is a case of jumped out of bail. Non Bailable Warrant was issued on 24.04.2014 and the petitioner was arrested only on 08.11.2024.

6. Considering the facts and circumstances and also considering the fact that the petitioner has two previous cases, out of which, one case is relating to murder, this Court is of the considered view that if the bail is granted to the petitioner, there is very possibility for absconding and delaying the trial. Hence, this Court is not inclined to grant bail to the petitioner.
