PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the entire records pertaining to the FIR in Cr.No.183 of 2023 dated 03.06.2023, on the file of the Sub Inspector of Police, Kottampatti Police Station, Madurai District and quash the same in respect of the petitioners. 1/4

ORDER

The present petition has been filed by the accused persons in crime No. 183 of 2023 on the file of the first respondent police wherein they are alleged to have committed offences under Sections 147, 294(b), 323, 324 and 506(i) of IPC.

2. The learned Counsel for State of TN(crl.side) appearing for the first respondent police submitted that the petitioners 1 to 5 have been deleted in the charge sheet. As far as the 6th petitioner, namely, Parthiban, is concerned, the charge sheet has been laid as against him on 26.03.2025 before the learned Judicial Magistrate, Melur, through e-filing.

3. In view of the fact that the charge sheet has been laid as against the 6th petitioner, the present prayer seeking quashing of the FIR is not maintainable. It is open to the petitioner to initiate appropriate proceedings. 2/4

4. With the above said observations, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is also closed.
