Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 and 2 to instruct the respondents 5 and 6 to take immediate steps to pay the Disable persons monthly Benefit funds every month regularly with arrears, then only the Disable persons will get peaceful life in future by considering the petitioner's representation dated 10.11.2016. For Petitioner : Mr.A.Vetri Selvan (Party-in-Person) For Respondents : Mr.M.Govindan Special Government Pleader.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 4 to 6 to take immediate steps to pay Disabled Persons Monthly Benefit Funds every month with arrears, by way of issuing a writ of mandamus. 2.It is averred in the petition that the petitioner is a resident of A.Vallalapatti Village, Melur Taluk, Madurai District. Further it is averred in the petition that the respondents 4 to 6 have not paid Disabled Persons Monthly Benefit Funds every month. Under the said circumstances, a representation dated 10.11.2016 has been given and the same has not been considered and therefore the present writ petition has been filed for getting the relief sought therein.

3.Mr.M.Govindan, learned Special Government Pleader, has taken notice for all the respondents.

4.Considering the fact that the disabled persons are legally entitled to get monthly benefits and also considering that the respondents 4 to 6 have failed to pay the same and also considering the fact that a representation has been given on 10.11.2016, this Court is inclined to pass the following order. 5.In fine, this writ petition is allowed in part without costs and the respondents 4 to 6 are strictly directed to pay Disabled Persons Monthly Benefit Funds every month and also arrears without delay.
