Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the 1st respondent pertaining to its proceeding bearing No.RFL/Karanthattankudi/144/2025 dated 05.05.2025 and to quash the same and consequently direct him to register the settlement deed dated 19.03.2025 and the same is represented by the second respondent on behalf of her principal through a registered power of attorney deed dated 27.03.2025 and which is duly adjudicated before the Joint I Sub Registrar Thanjavur adjudication No.49/2025 in respect of the properties mentioned in the said deed.

ORDER

The present writ petition has been filed challenging the refusal slip issued by the first respondent herein, wherein, a settlement deed presented by the petitioner for registration has been refused on the ground that they are doubting the signature of the executor of the document.

According to the learned Counsel for the petitioner the executor of the settlement deed dated 19.03.2025 has presented the document in person to the first respondent and the same was returned for carrying out certain defects. Before it could be represented, the executor, namely Mrs.Keerthana had left for Singapore. From there she had executed a power of attorney for the presentation of settlement deed. When the settlement deed executed by the said Mrs.Keethana was presented before the first respondent along with the power deed, a refusal slip has been issued by the first respondent doubting the signature of Mrs.Keerthana in the settlement deed.

3. The learned Counsel appearing for the petitioner submits that they would get an affidavit from Mrs.Keethana from Singapore, after being attested by the Indian Embassy at Singapore.

4. In case, such an affidavit attested by the Indian Embassy at Singapore is presented, the first respondent is directed to register the settlement deed, if it is otherwise in order.

5. With the above said observations, this writ petition is disposed of. No costs.
