ORDER

This writ petition is filed seeking a writ of Mandamus, directing the second and third respondents to consider the representation of the petitioner dated 14.09.2017. 2.The learned counsel for the petitioner would submit that neither civil suit nor rival claim whatsoever is pending in respect of the property in question. The case of the petitioner is that the property in survey No.398/1 situated at Sikkathambur, North village, Thuraiyur Taluk, Trichy District, was purchased by his grandfather through a registered sale deed dated 29.08.1941. Earlier the patta stood in the name of the petitioner and he had also been paying kist and has been in possession and enjoyment of the same. While so, the name in the patta has been transferred in https://hcservices.ecourts.gov.in/hcservices/

the name of fourth and fifth respondents, without either notice or personal hearing to the petitioner. So the petitioner has sent a representation dated 14.09.2017 to the respondents to delete the name of the fourth and fifth respondents in the patta, but, no action has been taken on the representation of the petitioner. Therefore the petitioner is before this Court. 3.The learned Special Government Pleader appearing for the respondents would submit that the representation of the petitioner would be considered on merits, within the time stipulated. 4.Considering the limited scope of the relief sought, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 14.09.2017on merits and in accordance with law, after affording due opportunity to the petitioner and also to the interested parties, if any and pass necessary orders within a period of six weeks from the date of receipt of a copy of this order.

5.With the above directions, the writ petition is disposed of. No Cost.
