PRAYER: Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondents 1 to 5 to remove the encroachment made in the pathway of burial ground situated in S.F.No.141/1 Cholamadevi Village, Navalpattu Post, Trichy based on the communication in Na.Ka.No.A2/3246/2021 dated 28.12.2021 within a time stipulated by this Court. (Order of the Court was made by P.N.PRAKASH, J.) It is the case of the petitioner that adjacent to the burial ground in Cholamadevi Village, there are encroachments in S.F.No.141/1 that have been made by some persons, which is obstructing the pathway to the burial ground and therefore, the present writ petition has been filed for a direction to the authorities to remove the same. 2.Today, Mr.N.Naganathan, Revenue Inspector, Thiruverambur, is present.

3.On instructions, the learned Additional Government Pleader, submitted that steps are being taken by the Block Development Officer to remove the encroachments by issuing notice to the alleged encroachers. He further submitted that the Block Development Officer is not a party in this petition, whereas, the Regional Development Officer has been shown as the third respondent.
4.Recording the submission of the learned Additional Government Pleader, this petition is closed with a direction to the Block Development Officer, Tiruverambur to take appropriate action in accordance with law for removal of the encroachments, if any.
5.The writ petition is disposed of with the above direction. No costs.
