ORDER

This petition is filed to relax the condition imposed on the petitioner in Crl.M.P.(MD)No.13902 of 2024 in Crl.A.(MD)No.1122 of 2024, dated 28.02.2024.

2. The learned counsel appearing for the petitioner submitted that the petitioner is aged 25 years and he is working as a Driver and while passing the order for suspending the sentence, this Court directed the petitioner to stay at Tiruppur and report before Tiruppur South Police Station daily at 10.30 A.M. It is further submitted that the petitioner has been complying the condition without any default 1/3

and this fact is confirmed by the learned Government Advocate (Crl. Side) also.

3. It is seen from the Judgement that the victim herself has not supported the case of the prosecution while deposing before the Court. The father of the victim also did not give any incriminating evidence against the accused. Taking into consideration of all these facts, I feel that the condition imposed on the petitioner may be modified.

4. Accordingly, the condition already imposed is modified as to the petitioner shall appear and sign before the learned Sessions Judge, Fast Track Mahila Court, Dindigul on the 1st day of every English Calender month (if is a holiday, then he shall sign the next day) at 10.30 a.m., until further orders.

5. It is made clear that the petitioner shall not try to contact the victim or her family members either directly or indirectly and intimidate them in any way.
