PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.1278 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A.2, who was arrested and remanded to judicial custody on 27.05.2022 for the offences punishable under Sections 4(1)(aa) r/w 4(1-A) of TNP Act and Sections 4, 6 and 7 of TN Rectified Spirit Rules, 2000, in Crime No.1278 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and other accused were found in illegal possession of 80 litres of arrack. Hence, the complaint.

3. When the matter is taken up for hearing today, the learned counsel for the petitioner as well as the learned Additional Public Prosecutor would submit that the petitioner was detained under the TN Act 14 of 1982.

4. Considering the above facts and circumstances and also the seriousness and gravity of the offence alleged against the petitioner and also the fact that the petitioner was detained under https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.12540 of 2022 the TN Act 14 of 1982, this Court is not inclined to grant bail to the petitioner.
