ORDER : The Court made the following order :- The petitioner / accused No.6, who apprehend arrest at the hands of the 1/4

respondent police for the offences punishable under Sections 49, 61(2), 137(2) & 308(4) of BNS, 2023, in Crime No.24 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the accused illegally transported Ganja in a boat for which the accused persons requested the defacto-complainant to help them for loading of Ganja. After knowing the said illegal act, the defacto-complainant has informed the same to customs department. In order to wreak vengeance, the accused persons abducted the defacto-complainant and demanded a sum of Rs.6,00,000/- from the defacto-complainant and isolated him in the secluded place. Thereafter, the defacto-complainant's mother gave a sum of Rs.2,00,000/-. Thereafter, the accused persons released the petitioner. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent person and a false case has been foisted against him. The petitioner is only arrayed as sixth Accused in the case, already one of the co-accused had obtained anticipatory bail before this Court. Further, he would submit that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Crl side) would submit that the petitioner is having two previous cases and the investigation is not yet completed. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioner is having two previous cases and the investigation is not yet completed, this Court is not inclined to grant anticipatory bail to the petitioner.
