PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to hand over the possession of the property situated at Karur R.D., West Karur S.R.D., Karur Taluk, L.N.S., Village bearing S.F.No.629 Ac 0.98 in which as house site measuring an extent of 911 sq.ft., with ground floor, first floor, second floor and third floor RCC building thereon to the petitioner in pursuance to Certificate of sale deed dated 30.01.2026 executed by the first respondent within time frame as fixed by this Court.

ORDER

(Order of the Court was made by C.V.KARTHIKEYAN, J.) The writ petition has been filed in the nature of the Mandamus seeking direction against the respondents 1 to 3 / Authorized Officer, Indian Bank, Karur District, Superintendent of Police, Karur District and the Inspector of Police, Karur Town Police Station, to hand over the possession of the property at 2/5

S.F.No.629 measuring 0.98 acres wherein, there is a house-site which measures to an extent of 911 square feet comprising ground floor, first floor, second floor and third floor with RCC building to the petitioner in L.N.S., Village, Karur Taluk, consequent to a certificate of sale dated 30.01.2026 executed by the 1st respondent within a fixed time frame.

2. There have been several litigations relating to the subject property and one which is pending as on date is before the Debts Recovery Tribunal at Coimbatore in S.A.No.25 of 2026. We would, therefore, refrain ourselves from examining more details on the contention of the petitioner relating to his right over the property. Be that as it may, Mr.P.Valliappan, learned Senior Counsel stated that in accordance with the earlier undertaking, the possession of the property had been handed over to the petitioner. This fact is confirmed by the learned counsel for the petitioner and also the learned counsel for the 1st respondent. In view of that particular fact, we would not pass any further orders but record the fact that possession had been handed over to the petitioner. 3/5

3. The Writ Petition stands disposed of. No costs. The rights of the parties may be agitated in S.A.No.25/2026 pending before the Debts Recovery Tribunal, Coimbatore, in accordance with law.
