For Petitioner : Mr.Y.Arulanandasamy For Respondent : Mr.J.Senthil Kumaraiah COMMON ORDER W.P.(MD)No.15192 of 2021 has been filed by the Transport Corporation, challenging the order of rejection, passed by the Labour Court, Madurai, in I.A.No.672 of 2019 in C.P.No.70 of 2011 dated 03.12.2020. 2/6

On the claim petition in C.P.No.70 of 2011 filed by the respondent/workman, an ex parte order was passed by the Labour Court, Madurai, on 19.12.2011, directing the petitioner Transport Corporation to pay a sum of Rs.4,08,464/-. Therefore, the Transport Corporation has filed an interlocutory application in I.A.No.672 of 2019, seeking to condone the delay of 3255 days in filing the petition to set aside the ex parte order passed by the Labour Court, Madurai, in C.P.No.70 of 2011 dated 19.12.2011. The Labour Court, Madurai, by order dated 03.12.2020, rejected the same. Challenging the same, the Transport Corporation has preferred the writ petition in W.P.(MD)No.15192 of 2021.

The respondent/workman has also filed another claim petition in C.P.No.89 of 2019, before the Labour Court, Madurai, claiming salary for a period of 85 months by fixing wages on par with those persons, who joined the service during the same period. The Labour Court, Madurai, by order dated 14.05.2024, rejected the claim petition filed by the workman. Therefore, the respondent/workman has filed the writ petition in W.P. (MD)No.4146 of 2025, seeking to quash the order passed by the Labour Court, Madurai, in C.P.No.89 of 2019 dated 14.05.2024 and a consequential 3/6

direction to direct the Transport Corporation to pay the amount as claimed in C.P.No.89 of 2019.

4. Pending these writ petitions, on the request made by the learned counsel on either side, this Court, by its order dated 21.03.2025, referred the matters to the Lok Adalat.

Now, it is reported by the learned counsel on either side that before the Lok Adalat, the respondent/workman has confined his claim for a sum of Rs.14 lakhs and the same has been accepted by the Management and a proposal has also been made to the Board to sanction the amount as agreed by the respondent/workman before the Lok Adalat.

In view of the representations made by the learned counsel on either side that before the Lok Adalat, a settlement has been arrived at between the parties for a sum of Rs.14 lakhs and a proposal has also been made by the Management to the Board to sanction the amount for disbursement of the claim amount to the respondent/workman, these writ petitions are disposed of with a direction to the Transport Corporation to settle the claim amount of Rs.14 lakhs, as agreed by the Management before the Lok Adalat, to the 4/6
