PRAYER : Writ Petition Criminal is filed under Article 226 of Constitution of India to issue a writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the respondent No.3 in Na.Ka.No. 03/FORECAST/S8PS/2026 dated 21.04.2026 and quash the same as illegal and consequently direct the respondents to grant permission to conduct temple festival of Arulmigu Sri Angayarkanni Amman, Sri Kaaliyamman, Sri Uchinanamahaliyamman, Sri Mariyamman Kovil Kodai Festival function and other cultural programs along with 'Adal and Padal' program which will be held on 29.04.2026 at about 7.00 at Arulmigu Sri Angayarkanni Amman, Sri Kaaliyamman, Sri Uchinanamahaliyamman, Sri Mariyamman Kovil Kodai 1/5

ORDER

The present petition has been filed seeking to quash the order passed by the third respondent herein on 21.04.2026 wherein the request of the petitioner to grant permission to conduct 'Adal and Padal' festival on 29.04.2026 has been rejected.

2.A perusal of the impugned order reveals that there is a possibility of law and order problem and last year, the petitioners are said to have exceeded their time limit beyond 10.00 p.m. On these two grounds, the request of the petitioner for conducting 'Adal and Padal' festival has been rejected. 3.The learned counsel appearing for the petitioner relied upon a decision of this Court in WP(MD).No.13426 of 2025 dated 30.04.2025 and submits that last year, a similar rejection order was put to challenge and it was set aside and permission was granted for conducting 'Adal and Padal' program between 6.00 p.m to 10.00 p.m.

4.The learned Government Advocate (Crl.side) appearing for the respondent police has brought to the notice of the Court that last year they exceeded the time limit and therefore, considering the election time and law and order problem, the order passed may be sustained. 5.Heard the learned counsel appearing on either side and perused the material records.

6. The order impugned in the writ petition has been passed primarily on the ground that there is a possibility of law and order problem and last year, they have exceeded the time limit. This Court is of the considered opinion that the order could be set aside with a strict direction to the petitioner to comply with the directions issued by the Court with regard to the time limit. 7.The order impugned in the writ petition is set aside and the respondent police are directed to provide police protection to the petitioner to conduct 'Adal and Padal' on 29.04.2026 between 6.00 p.m to 10.00 p.m. It is made clear that in case, if they exceed the time limit, the police authorities are entitled to stop the said program and this will disqualify the petitioner from approaching either the police authorities or this Court for making a request for 'Adal Padal' festival in the subsequent years.

8.With the above said observations, this Writ Petition Criminal stands disposed of.
