ORDER

This writ petition has been filed seeking a direction to the respondents 2 and 3 to revise the salary of the petitioner in accordance with 12(3) Settlement dated 03.03.2014 in Number B4-21412014 and pay arrears and other consequential benefits with effect from 01.04.2013.

2.Heard the learned counsel appearing for the petitioner; the learned Government Advocate for the respondents 1 and 2 and the learned counsel for the third respondent.

3.The learned counsel appearing for the petitioner submitted that the petitioner is serving as a Secretary in the third respondent Society and as per the settlement entered under Section 12(3) of the Industrial Disputes Act, 1947, dated 03.03.2014, the petitioner is entitled to revised scale of pay. Since his pay was not revised, he made a representation dated 19.07.2017 and the same has not been considered so far. Hence, the petitioner is before this Court.

4.The learned Government Advocate appearing for the respondents 1 and 2 and the learned counsel for the third respondent submitted that the representation of the petitioner would be considered on merits and appropriate orders be passed. 5.In view of the above submission, this Writ Petition is disposed of, directing the respondents to consider the representation of the petitioner dated 19.07.2017, in the light of the terms of settlement dated 03.03.2014 entered under Section 12(3) of Industrial Disputes Act, 1947 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner. No costs.
