PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the second respondent to consider the petitioner's representation dated 11.06.2022 and provide sufficient Police protection to the life and limb of the petitioner and his family members. This Criminal Original Petition has been filed to direct the second respondent to consider the petitioner's representation dated 11.06.2022 and provide sufficient Police protection to the life and limb of the petitioner and his family members.

2. The case of the prosecution is that there was a dispute with regard to the property in Survey No.831/2B2 situated at Eriodu Village, Vedasanthur Taluk, Dindigul District between the petitioner and the third respondent. Hence, the petitioner seeks Police protection by giving representation dated 11.06.2022. Since no action was taken, the present Criminal Original Petition has been filed.

When the matter is taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that on receiving the representation of the petitioner dated 11.06.2022, they have conducted the enquiry with the petitioner and the private respondent and C.S.R. receipt in C.S.R.No.183 of 2022 was also issued. On enquiry, they found that there is a dispute between the petitioner and the third respondent with regard to the properties in Survey No.831/2B2 situated at 2/5

Eriodu Village, Vedasanthur Taluk, Dindigul District. In this regard, the Revenue Divisional Officer, Palani, conducts an enquiry and it is pending on the file of Revenue Divisional Officer. The parties are agreed to settle their matter with the result of enquiry by the Revenue Divisional Officer, Palani and approach the Civil Court for further action.

4. I have considered the matter in the light of the submissions made by learned counsel for both the parties and perused the records.

5. On perusal of the records it is seen that on enquiry, the respondent Police recorded the statement of the parties and also found that the Revenue Divisional Officer also conducts an enquiry and the enquiry is still pending. The parties are agreed to get appropriate remedy before the Civil Court.
