PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the third respondent to install the drinking water pipeline over the public pathway situated in survey No.190/7, Thirupparankundram Taluk, Madurai for the benefit of the residents, including the petitioner.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The learned counsel for the petitioner would submit that the encroachments in the public pathway has been removed. Thus, the authorities have to maintain a road properly, however, the encroachers are again attempting to encroach upon the property. The respondents shall ensure that the public road is free from encroachments and for public usage. In the event of any such encroachments, the encroachers are to be removed by following the procedures as contemplated under the Act and Rules.
