PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue Writ of Mandamus, to direct the third respondent to release the Bolero Pick Up bearing Registration No.TN 58 AH 3197 to the petitioner within the time stipulated by this Court. ORDER

The petitioner is the owner of the petition mentioned vehicle. The said vehicle was seized by the third respondent in connection with Crime No.289 of 2021 on the file of the Uchipuli Police Station, Ramanathapuram District under Section 102 of Cr.PC. Seeking release of the petition mentioned vehicle, this writ petition came to be filed.

2.Heard the learned counsel on either side.

3.The vehicle was seized as early as on 15.06.2021. I wanted to know from the learned Additional Public Prosecutor as to whether the petition mentioned vehicle was involved in any offence. It is fairly stated that the vehicle has not been involved in any previous https://hcservices.ecourts.gov.in/hcservices/ 1/2

WP(MD)No.14931 of 2021 offence. The vehicle in question has not been produced before the court below till date. The jurisdictional police is directed to release the petition mentioned vehicle forthwith and without any delay. Of course, the petitioner has to produce ownership details. The writ petition is allowed. No costs.
