O R D E R

This petition has been filed seeking a direction to the respondents to consider the representation dated 28.06.2021 and reminder representation dated 13.08.2021 and take action in accordance with law within the time stipulated by this Court.

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that based upon the complaint given by one Vijayabharathi, a case in Crime No.388 of 2021 has been registered against 7 persons among which the petitioner is the first accused. The offences alleged are Sections 147, 447, 294(b), 323, 506(ii) IPC, wherein the above said Vijayabharathi has stated that he is running a Hot Chips in K.K.Nagar and he was a sub-lessee for monthly rent of Rs.14,000/- and advance amount of Rs.2,50 lakhs was received. Later trouble arose between them. So he launched a complaint on 26.04.2021 and that was closed with the direction to the parties to work out their remedy before the civil court. So after that the occurrence took place in respect of which the above said case has been registered. Similarly the petitioner has given a complaint against one Kasinathan in respect of the very same tenancy dispute and that is https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.14918 of 2021 pending. However, the very same complaint has been given on 16.04.2021 also against the said Kasinathan and Gunalan. After enquiry, that was closed. The above said Gunalan filed W.P(MD)No.636 of 2021 before this Court seeking a direction to the respondent police not to harass and during the enquiry it was pointed out that the complaint given by the petitioner came to be closed as civil in nature. It appears that there is continuous dispute between the parties regarding the shop. Since the case has been registered against the petitioner, he has to work out his remedy appropriately. In respect of the complaint given by him it appears that enquiry is underway. Since the grievance of the petitioner has been redressed by undertaking an enquiry in CSR No.379 of 2021, nothing survives for further consideration or direction. Let the enquiry be concluded with a short time.

3. With the above direction, this petition is disposed of.
