PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondents not to harass the petitioner's son namely Sivakumar, aged 15 years, except under due process of law.

ORDER

This petition has been filed to direct the respondents not to harass the petitioner's son namely Sivakumar, aged 15 years, except under due process of law, under the guise of complaint given by third party.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by one Saravanakumar, a case in Crime No.287 of 2021, for the offences punishable under Section 394 IPC was registered in crime No.287 of 2021 on 29.03.2021, wherein, the suspected accused three in number. He would further submit that one of the accused by name Manicka Vijay @ Seendi has given a confession statement to the effect that the petitioner's son is also involved in the above said occurrence/crime. Copy of the confession statement given by the co-accused is also circulated to this Court. 3.The submission made by the learned Additional Public Prosecutor is placed on record.

Since enquiry is pending, the petitioner is directed to appear before the enquiry officer and cooperate with him, to complete the enquiry. Since it is stated that the petitioner's son is aged about 15 years, the enquiry officer is directed to conduct enquiry in accordance with law and as per the procedure contemplated in Juvenile Justice (Care and Protection of Children) Act, 2000.
