The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 29.07.2024 for the offences punishable under Sections 120(b), 147, 148, 341, 302, 506(ii), 109 and 149 of IPC in Crime No.85 of 2018 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 28.01.2018 at about 21.30, due to previous enmity, the petitioner attacked and murdered the Defacto-complainant's son. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner not committed any offence, false case has been foisted against him, due to his nonappearance before the learned Judicial Magistrate Court No.III, Dindigul for the hearing date in PRC.No.32/2018 on 29.12.2023 a NBW was issued against him upon execution of NBW, on 29.07.2024, the accused was arrested by the respondent police and remanded to judicial custody. He is in judicial custody for the past 310 days. The petitioner is law-abiding citizen and he will not abscond himself and he is ready and willing to abide any stringent conditions imposed by this Court. Hence, he seeks bail.
4. The learned Government Advocate (Criminal Side) would submit that the petitiioner murdered the Defacto-complainant's younger son namely Dhatchinamoorthy and elder son Sakthivel and one Arulalanthababu. The Defacto2/4
complainant approached this court to seek police protection and she is living with the security of police. The petitioner/accused is having intention to murder her and her family members. There are totally 13 accused persons involved in this case. This petitioner was arrayed as first accused. This petitioner murdered two persons, the allegations against the petitioner are serious in nature. Moreover, this petitioner is the History-sheeter (H.S.No.12/17) and he is having 12 previous cases. Hence, he objected to grant bail to the petitioners.

Taking into consideration of the facts and circumstances of the case and also taking into consideration of the fact that the petitioner is having bad antecedents and he is having 12 previous cases and also he is a History-sheeter and also considering the gravity and nature of offence involved in this case, this court is not inclined to grant bail to the petitioner.
