ORDER

The present writ petition has been filed seeking mandamus as against the fourth respondent to handover MBBS Degree Certificate and other certificates considering the request of the petitioner.

2.A perusal of the records reveal that the petitioner has completed her P.G.Course and she is expected to continue in two years bond service with the respondents. However, the petitioner has now been selected for Super Speciality Course and she wishes to join the Super Speciality Course. 3.In view of the above said selection, the petitioner would like to continue her bond service after completion of the Super Speciality Course and has filed the present writ petition seeking to handover the certificates as mentioned in the prayer.

4.A similarly placed person has been allowed by this Court in WP(MD).No.26793 of 2022 dated 10.10.2022. This Court is inclined to follow the said order and extract the following relevant portion: 2/5

"* That the petitioner shall execute an indemnity bond with an undertaking that the two years bond period can be extended for further period of two years after the petitioner completes the Super Speciality Course for which he has been qualified now and after he completes the Super Speciality Course in Medicine, he would against serve the fourth respondent institution or any other institution at the instance of the fourth respondent institution for a period of two years. * On receipt of such undertaking to be executed by the petitioner, the fourth respondent institution shall release the original certificates held by them which were submitted by the petitioner along with the provisional certificate of the P.G.Degree Course, enabling the petitioner to join in the Super Speciality Course." 5.In view of the order passed by this Court in a similar writ petition, this writ petition stands allowed on the above said terms.
