For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 12 of 2020 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent Police, for the offence punishable under Sections 409, 420 and 120(B) IPC, in Crime No.12 of 2020, on the file of the respondent Police, seeks anticipatory bail.

2. The petitioner was working as a Branch Manager of Indian Overseas Bank. The allegation against the petitioner is that while he was working as a Branch Manager, he sanctioned various credit facilities to six members of the same family and committed certain irregularities, which are as follows:

(i) All the six members were sanctioned cash credit facility of Rs.10 lakh each for the same purpose;

(ii) The petitioner had allowed excess to the tune of Rs.2.50 lakh in all the six accounts on 27.09.2018 which is beyond his powers;

(iii) The petitioner had also sanctioned dairy loan of Rs.1 lakh and KCC of Rs.1.60 lakh each to all the six borrower, thereby he had exceeded his financial powers.

CRL OP(MD). No.12077 of 2021 (iv) A vehicle loan was sanctioned to one of the borrower Mr.Rajapandi for Rs.6.75 lakhs.

(v) The Branch Manager/Petitioner had received Rs.60 lakh of cash from the customer.

Now, a sum of Rs.84,27,626/- is outstanding and since all the accounts have become NPA, it is difficult for the Bank to recover the same. Hence, the present complaint.

3. Today, when the matter is taken up for consideration, the learned Additional Public Prosecutor submitted that considering the gravity of offence,the respondent Police is taking steps for transferring the case to the Central Bureau of Investigation (CBI).

4. Considering the gravity of offence,irregularities committed by the petitioner and huge value of outstanding amount, this Court is not inclined to grant anticipatory bail to the petitioner.
